These Terms are governed by the laws of the United States, without regard to conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Binding Individual Arbitration & Class-Action Waiver
You and RetireCiv agree to resolve any dispute arising out of or relating to these Terms or the Service through binding individual arbitration, not in court, and you waive any right to participate in a class action, class arbitration, or representative proceeding.
Arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will be conducted in the U.S. county where you reside, or by telephone or video conference at your option. The arbitrator's decision is final and binding, and judgment on the award may be entered in any court of competent jurisdiction.
Carve-outs. Either party may bring an individual action in small-claims court for disputes within that court's jurisdiction. Either party may also seek injunctive or equitable relief in court to protect intellectual-property rights.
30-day opt-out. You may opt out of this arbitration agreement by sending written notice to support@retireciv.com within 30 days of first accepting these Terms. Your notice must include your name, the email associated with your account, and a clear statement that you wish to opt out of arbitration. Opting out does not affect any other provision of these Terms.
If the arbitration agreement is held unenforceable, any dispute will be resolved exclusively in a court of competent jurisdiction in the United States, and you consent to personal jurisdiction in that court.
